Procurement and Public Administration Reform Specialist
I. INTRODUCTION
1. The Government of the Democratic Republic of Timor-Leste has received
a grant from the Japan Fund for Poverty Reduction through Asian
development Bank (ADB) towards the cost of "Our Roads, Our Future –
Supporting Local Governance and Community Based Infrastructure Works".
Part of this grant will be used for consulting services of an
international Procurement and Public Administration Reform Specialist.
The consultant will work under the supervision of a Project Coordinator
and in coordination with other Project Management Unit members of the
Road Network Development Sector Project.
2. The total duration of the assignment is 3 person-months. The
assignment will be split into two interventions: a first 1.5 month
intervention will take place in the second quarter 2011. The second 1.5
month intervention will take place in the second half of the project
implementation period, in 2012 or 2013 depending on local
circumstances.
3. Terms of Reference (TOR) are provided below.
4. Provided that you are interested in undertaking the assignments under
the Project, you are hereby invited to submit an Expression of Interest
together with your curriculum vitae for the services required under the
TOR. The competence of the staff will be considered by the MOI on its
relevant experience and capabilities to handle ADB projects in Timor
Leste. There will be a ranking of shortlisted candidates and the first
ranked will be invited for financial negotiations and ultimately a
contract will be signed between the Consultant and the MOI. It is
anticipated that contract negotiation with consultant would take place
in May 2011 and the assignment would commence in May or June 2011.
5. Your submission of Expression of Interest with the Curriculum Vitae
shall remain valid for a period of 45 days after the submission date of
15 April 2011 (or as per the deadline advertised in the CSRN on the ADB
website, if different from this one). During this period you shall
maintain your availability for the said position. The MOI will make its
best effort to complete negotiations within this period. If the
negotiation cannot be completed on the said period of time, the MOI may
request to extend the validity period of your proposal. You have the
right to refuse to extend the validity period of your proposal.
II. TRANSMISSION ARRANGEMENTS
6. An Expression of Interest and detailed curriculum vitae should be
prepared in English and should be submitted in hard copy or in soft copy
to the following address not later than 5:00PM on 15 April 2011 (or as
per the deadline advertised in the CSRN on the ADB website, if different
from this one);

III. EVALUATION OF CURRICULUM VITAE AND FINANCIAL NEGOTIATION
7. The curriculum vitae will be evaluated, prior to the invitation for
financial negotiation, on the basis of the qualification of the
individual candidate to be selected. The summary of criteria to be used
for evaluating the curriculum vitae can be provided in the Office
address in Section III.
8. Following the completion of evaluation of curriculum vitae, the
financial negotiation will be conducted with the Consultant.
9. If contract negotiation fails for any reason, the MOI will invite
another Consultant.
V. REQUEST FOR ADDITIONAL INFORMATION
10. In the event that you may need additional information, we would try
to provide such information expeditiously but any delay in providing you
with such additional information will not be considered as a reason for
extending the submission date of your proposal.
Terms of Reference

Background
The Government of the Democratic Republic of Timor-Leste has received a
grant from the Japan Fund for Poverty Reduction through Asian
development Bank (ADB) towards the cost of "Our Roads, Our Future –
Supporting Local Governance and Community Based Infrastructure Works".
The project is a 4 year project which started early 2010 and will finish
at the end of 2013. Under the project, the Government of Timor Leste
will implement rural feeder road rehabilitation and maintenance
activities and various small scale community infrastructure
constructions, in partnership with local communities and with the
participation of local government. To support this project and continue
working in the rural road sector beyond the life of the project, the
Government of Timor Leste through the Project Management Unit is seeking
to recruit one Procurement and Public Administration Reform specialist.
Description of services
The Procurement and Public Administration Reform Specialist will be
responsible for the following:
(i) Review project documents and reports, and procurement rules
currently adopted by ADB, the Government of Timor Leste (local and
central) including the Ministry of Infrastructure, and other donor
projects implementing rural road rehabilitation and maintenance works in
Timor Leste, and evaluate their applicability to the JFPR project.
(ii) Prepare procurement rules and regulations and sample contracts
and bidding documents for the JFPR project, which will be adopted by
district level personnel and all project related staff, when contracting
out civil works to community groups and contractors. To the extent
possible, those documents must build on existing procurement rules used
by district administrations under the Local Development Fund/ LGSP with
some adaptation to fit the socio-economic objectives of the JFPR
project. In addition, the procurement rules must comply with ADB
procurement guidelines (2007, as amended from time to time) and, to the
extent possible, other Government procurement guidelines. The ultimate
objective would be to produce a standardized set of documents that could
be used by the government in the long term for implementing simple rural
road works contracts using community labor, and which could reconcile
various donor requirements.
(iii) Develop a training module and implement an initial training on
financial management, procurement, contract management and monitoring
for district personnel, MOI district level staff, the Project
Implementation Consultant (NGO/Firm contracted under the project), and
any other relevant participants.
(iv) Provide ongoing training on capacity building in financial and
contract management for district administration.
(v) Assist the technical working group in MOI to explore and decide
upon whether and how its basic service delivery functions (or
sub-functions) can be decentralized to the municipal level while making
subsidiarity the key principle. In addition, the consultant will review
and clearly define how such services would be costed and financed, as
well as how they would be moved from national to local government
budgets.
(vi) Assist the Ministry of State Administration in proper backstopping
of the pilot district administrations, including identifying and
developing relevant training modules.
(vii) Provide technical assistance to the district administrations in
implementing their delegated responsibilities (notably including
contract management).
In addition to direct project stakeholders, the consultant must
collaborate with Chief of Procurement of Directorate of Roads, Bridges
and Flood Control, and the Ministry of State Administration and
Territorial Management throughout the course of the assignment. Close
collaboration will also be required with other donor projects working on
rural roads and rural infrastructure in general in Timor Leste, in order
to facilitate exchange of lessons learned, and maximize synergies and
standardization of approaches across partners.
The procurement and contract management processes should: (i) involve
the participation of district level staff of MOI directly employed by
the project, (ii) to the extent possible, introduce feed-back mechanisms
from communities throughout the design and contracting process, (iii)
must give strong opportunity for local small contractors from the suco
or from within the sub-district to participate and (iv) must solicit
regular reviews by PMU.
Timing
The total duration of the assignment is 3 person-months. The assignment
will be split into two interventions: a first 1.5 month intervention
will take place in the second quarter 2011 to prioritize tasks (i)
through (iii) above. The second 1.5 month intervention will take place
in the second half of the project implementation period, and would
prioritize tasks (iv) through (vii) above.
